Although the Biden administration is pretending to finally get tough on the border, it’s business as usual behind the scenes.

The New York Post reports the federal government has been operating a “mass amnesty” program for migrants.

“Data show that since 2022, more than 350,000 asylum cases filed by migrants have been closed by the US government if the applicants don’t have a criminal record or are otherwise not deemed a threat to the country,” the outlet stated.

From the New York Post:

This means that while the migrants are not granted or denied asylum — their cases are “terminated without a decision on the merits of their asylum claim” — they are removed from the legal system and no longer required to check in with authorities.

The move allows them to legally, indefinitely roam the US without fear of deportation, effectively letting them slip through the cracks.

“This is just a massive amnesty under the guise of prosecutorial discretion,” according to Andrew Arthur, a former immigration judge who works for the Center for Immigration Studies.

“You’re basically allowing people who don’t have a right to be in the United States to be here indefinitely,” he added to The Post.

The Daily Wire reports:

A whopping 77 percent of those who’ve applied for asylum have been allowed to stay in the country under Biden, the report also found, all while the current asylum backlog is more than 3.5 million.

Those who’ve had their asylum cases terminated can reapply for asylum at a later date or hold out for other potential pathways to citizenship such as mass amnesty, which some Democrats have called on Biden to support.

The revelation comes as the United States has endured an unprecedented crisis on both our southern and northern borders. Authorities have recorded over 9.5 million nationwide encounters and 1.7 million estimated illegal immigrant gotaways under the Biden administration.

The foreign-born population residing in the U.S. has also reached a record high of 51.6 million people under Biden, with the massive increase being driven largely by mass illegal immigration.

The report coincides with news of the Biden administration ‘cracking down’ on entries at the southern border.

However, the ‘border crackdown’ still allows approximately 1.8 million illegal migrants into the country per year.

“Biden’s ‘border crackdown’ is a freaking JOKE. It still allows 1.8 MILLION illegals in per year, and deports a grand total of ZERO. NOT ONE ILLEGAL out of the 15 million he’s already let in will be deported under this ‘plan,'” Nick Sortor commented.

The New York Post explained:

The Biden administration announced an executive order Tuesday that it claims would shut down the US-Mexico border once illegal crossings hit 2,500 per day between points of entry for seven consecutive days — a “crackdown” that will still permit a minimum of 1.8 million new arrivals into America every year even if enforced properly.

The order, which is expected to take effect immediately, would lift border restrictions two weeks after the daily number of crossings averages 1,500 for seven days straight, senior administration officials said in a background call previewing President Biden’s 2 p.m. announcement.

The new restrictions include several exceptions, such as allowing migrants to cross the border who use the CBP One mobile application at a port of entry, as well as “unaccompanied children, victims of a severe form of trafficking, those who face an acute medical emergency or an imminent and extreme threat to life and safety and other non-citizens who have a valid visa or some other lawful permission to enter the United States,” the officials said.
