Prosecutors in the Rittenhouse case have repeatedly trampled on the defendants rights, from attempting to bring in evidence that the judge barred him from bringing up, to illegally coaching witnesses. In a just world, a mistrial with prejudice will be the outcome of this trial. New revelations about the prosecution withholding evidence from the defense make this even clearer. Daily Mail Reports–
“Prosecutors in the Kenosha shooter trial withheld evidence from the defense that was ‘at the center of their case,’ only sharing the high-definition drone video footage on which they have hung their prosecution after the trial had concluded”
The defense alleges that the prosecution shared much lower quality footage with them than what was presented in closing arguments at the trial. On Monday afternoon as closing arguments were being made in the Rittenhouse case, the defense filed a motion for the case to be dismissed with prejudice. A key part of the motion included the fact that the prosecution withheld evidence from the defense.
“Assistant District Attorney Thomas Binger played the enhanced drone footage to the jury during his closing statements and claimed that it showed Rittenhouse ‘pointing his gun’ at people – an assertion that opened the door to the state claiming Rittenhouse provoked the violence of the night of August 25, 2020. Now, in the motion obtained by DailyMail.com, Rittenhouse’s defense insist that the state only shared it with the defense after evidence had closed on Saturday November 13.” The Daily Mail reports.
On Tuesday morning, the jury began deliberations on the Rittenhouse case. Judge Bruce Schroeder told the jurors during jury instructions that if they find that Rittenhouse acted lawfully in self defense, “You’re done, and you can return a not guilty verdict without considering the lesser offense”. A final verdict has not yet been reached in the case.
