An illegal alien from China has been indicted after getting caught crossing into the United States with child pornography on his phone.

Tong Sun, a 45-year-old man from Suqian in the Jiangsu province of China, was arrested after U.S. Border Patrol found child pornography on his phone while he was at an immigration processing center in McAllen, Texas. Sun had crossed the southern border just as the Biden regime was lifting Title 42.

According to a criminal complaint, Sun gave agents permission to search his phone and found videos of an adult and child younger than five years old, and another with a girl under the age of 13.

Sun admitted to Homeland Security Investigations agents that he was aware of the videos and that “he intended to delete the videos in Mexico, prior to crossing into the United States illegally, but did not get the opportunity.”

Sun also reported that he bought the phone pre-used and said that it already contained videos from seven to eight years back

He now faces charges of possession of child pornography that has been mailed, shipped, or transported, according to federal records.

This week a federal grand jury issued a one-count indictment against Sun, according to a press release from the U.S. Attorney’s Office for the Southern District of Texas. He is expected to make his initial appearance before U.S. Magistrate Judge Scott Hacker at a soon-to-be-determined date.

The defendant faces up to 20 years in prison and a maximum fine of $250,000.
