The Fifth Circuit Appeals court has ruled that the Biden administration cannot ignore federal law regarding illegal immigrants who have committed crimes. According to federal law, authorities must arrest, detain, and remove criminal aliens convicted of crimes, and aliens who have been ordered to be deported.

The Epoch Times reports that Texas Attorney General Ken Paxton, one of the plaintiffs in the case, said Biden “tried to throw out immigration law, saying DHS didn’t have to detain criminal illegals.”

The Fifth Circuit Appeals Panel that ruled in favor of upholding the law consisted of three Republican-appointed judges. Judges Edith Jones is a Reagan appointee; Edith Clement is a George W. Bush appointee; and Kurt Engelhardt is a Trump appointee.

Their decision is a sharp departure from the careless approach Homeland Security Secretary Alejandro Mayorkas has taken toward illegal immigration.

Mayorkas, has been lenient on taking action against aliens, telling immigration agents they should not “rely on the fact of conviction … alone”.  And when recently asked about the border crisis said “I think that we are doing a good job.”

Open borders have been an issue since Joe Biden took office. And while it is likely that the Biden Administration will appeal the decision, it is being hailed as a win for the rule of law across social media platforms.
