A Nebraska woman was sentenced to 90 days in jail Wednesday for burning and burying her aborted fetus.

Celeste Burgess, 18, pled guilty to charges of concealing or abandoning a body earlier this year. Her mother, Jessica Burgess, 42, already pled guilty to providing her daughter with pills for an illegal abortion and the burning and burying of the fetus earlier this month.

Burgess avoided two more misdemeanor charges of false reporting and concealing the death of another person through an agreement with prosecutors. Her late third-trimester abortion violated Nebraska’s then-20-week ban on abortion.

Gov. Jim Pillen (R) signed a 12-week ban in Nebraska this May, slightly less than a year after the Supreme Court overturned Roe v. Wade, ending the constitutional right to an abortion at the national level.

When you hear of a mother and daughter bonding, you probably think of shopping trips, family dinners, or shared hobbies.

But for Celeste and Jessica Burgess, their collaborative act takes a much darker turn, one that involves the tragic end of a potential life, and a shocking disregard for law and morality.

At just 28 weeks gestation, an unborn baby is nearly fully developed, capable of dreaming, recognizing voices, and even surviving outside the womb with medical help.

Yet, it was at this crucial stage of development that 18-year-old Celeste Burgess and her mother, Jessica, decided to terminate the pregnancy, a decision that breached Nebraska’s then 20-week abortion law.

The term ‘abortion’ in this context is perhaps a euphemism, for it masks the harsh reality of their actions – they ended a life.

The fetal remains were not handed over to medical professionals, nor given a respectful end.

Instead, they were burned and buried, an act that perhaps speaks volumes about the callousness of the act.

The abortion, well into her third trimester, violated Nebraska law at the time that banned abortion after 20 weeks of gestation. Officials have said Jessica Burgess ordered abortion pills online, which she gave to her then 17-year-old daughter in the spring of 2022.

Jessica Burgess pleaded guilty earlier this month to providing an illegal abortion, false reporting and tampering with human skeletal remains. In exchange for her plea, charges of concealing the death of another person and abortion by someone other than a licensed physician were dismissed. She faces sentencing on 22 September.

A Norfolk police detective opened an investigation into the abortion following a tip, according to an arrest affidavit. Police secured a search warrant to gain access to Facebook messages between the two, in which prosecutors say the women discussed terminating the pregnancy and destroying the evidence. Police then found the burned fetal remains buried in a field.
