The attorney for the family of Walmart shooter Patrick Crusius says his mother called the police a few weeks before the mass shooting. She called out of concern that her son owned the AK-type firearm he eventually used to commit mass murder at an El Paso Walmart.

The Crusius family attorney Chris Ayres told CNN that the call was made to police in Allen, Texas by the mother of Patrick Crusius.

Chris Ayres and fellow attorney R. Jack Ayres said Crusius’ mother didn’t identify herself or her son in the call but was just concerned about her son’s age and lack of experience. During the call, she was transferred to public safety officer who told her that her son, 21, was legally allowed to own the gun. The police didn’t seek any information from her before ending the call.

The lawyers for Patrick Crusius said the call was not because she believed her son was a threat to anyone but just “informational”.

Should the Allen, Texas police have taken information on this gun owner? Should they have asked more questions?

The Allen Police Department spokesman said he wasn’t aware of a call and that there was no record of the call: “I have nothing in the database to support this claim,” he told USA TODAY Thursday.

The defense attorney for Crusius weighed in on the case against the 21-year-old mass murderer saying he will use whatever tactic he can to keep Crusius from being put to death.
