Time for a Fact-Check!
This came in from a reader who sent me a bunch of images of recent (September 2024) campaign rallies showing Kamala Harris standing in front of a podium with the PRESIDENTIAL Seal on it.
As we’ve covered here before, the use of the Presidential Seal is covered by the US Code and Code of Federal Regulations and its use is highly regulated:

- 18 U.S.C. § 713 – This statute governs the use of the Presidential Seal. This means that only the sitting president and those authorized by the president may use the seal in an official capacity.
- Code of Federal Regulations, 5 CFR § 2635.702 – This regulation prohibits the use of public office for private gain, which includes the use of official symbols such as the Presidential Seal for personal purposes. This regulation applies to current and former government employees, including the president.
While former presidents cannot use the official Presidential Seal, they often use a modified version of the seal. This modified version lacks certain elements of the official seal, such as the outer ring and the inscription “Seal of the President of the United States.” The use of this modified seal is not explicitly regulated by the same statutes but is a convention that respects the restrictions placed on the official seal.
In summary, the use of the Presidential Seal by former presidents is restricted by 18 U.S.C. § 713 and 5 CFR § 2635.702, which ensure that the seal is used only for official government purposes by the current president or those authorized by the president. Former presidents can use a modified version of the seal for personal and post-presidential activities, adhering to the spirit of these regulations.

So it was a great question from a reader….why is Kamala Harris allowed to use it?
But we do our homework around here and we don’t just publish rumors or false information just because it might get views or make people “feel good”.
And I do have the answer for you on this one.
I looked into these two photos to get more information:

My first question was: are the photos authentic?
I’ve included the photo credit information on each one, with one being an AFP photo and one from the AP.
I looked into it and both photos appear 100% authentic. In other words, yes that is Kamala Harris standing in front of the Presidential Seal.
So then I went and viewed the video footage and in each instances Joe Biden spoke at the event first and Kamala Harris was the second speaker.
In those instances where the President and Vice President speak at the same event back-to-back, I confirmed it is common and legally acceptable to leave one podium up for the entire event, and to display the highest ranking seal (President):

So that mostly settles it….
We report on the news openly and fairly here and I’m not just going to post some “gotcha” photos when my research reveals the true reason.
But I was left with one final question….is it appropriate for a Vice President who is running for President to use the Vice Presidential Seal at campaign rallies?
ChatGPT suggests the Seal should not be used at campaign events:

However…as I mentioned we report openly and honestly here and I did some additional research and I went back to one of President Trump’s most famous Rallies in the 2020 election….the midnight rally in Butler, PA (of all places) in the final week of the 2020 campaign.

And you can see in this screenshot I took that President Trump is indeed also using his Presidential Seal at this Campaign Rally.

So it appears to either be legal or so commonly done that it has become acceptable on both sides.
Ok, so I think that clears up that question — and a big thanks to the reader who sent this in, it was a great research project and allows us to get the truth out there!
But this actually leads me to a much bigger question…
Bigger and more important than all of this is why is President Trump STILL using his Presidential Seal right out in the open from 2020 through 2024?
Could it be because…….well, I think you know.

Well, well, well....what do we have here?
Why is President Trump still tooling around in a Golf Cart that proudly and prominently has the U.S. Presidential Seal displayed on it?
In case you don't know, even "Former Presidents" are generally not allowed to use the Presidential Seal.
They can use an altered version that lacks the outer-ring inscription, but not one that says "Seal of the President of the United States".
And yet, that's EXACTLY the version 45-47 was just seen tooling around in while playing a round of golf on "Break 50".
