The Department of Homeland Security issued a blunt warning Sunday to any noncitizen considering an illegal vote in an American election: federal investigators are watching, and criminal charges are on the table.

DHS Secretary Markwayne Mullin appeared in the agency’s new video as the November midterms approach and election-integrity fights intensify across the country.

The agency did not mince words:

The warning follows a nationwide series of federal cases. In an October 5 announcement, the Justice Department said 16 aliens had been charged with offenses involving illegal voting, fraudulent voter registration, false claims of U.S. citizenship and related election crimes.

Those cases span four federal districts. Two defendants were charged in Florida, three in Louisiana, one in Wisconsin and ten in Minnesota. The allegations include ballots cast in the 2022, 2024 and 2026 elections, as well as false citizenship claims on registration or naturalization forms.

One Wisconsin defendant allegedly registered on Election Day in 2024, signed a form falsely certifying that she was a U.S. citizen and then voted. In Minnesota, prosecutors accused several lawful permanent residents of voting or claiming citizenship in order to register.

Every defendant is presumed innocent unless proven guilty. But the charging documents demolish the lazy claim that illegal noncitizen voting is merely a made-up concern that never reaches a federal courtroom.

The argument has become even more combustible because elected Democrats continue to blur the line between lawful voters and people who could face immigration enforcement. A widely shared clip showed New York Gov. Kathy Hochul opposing ICE operations while saying people should not be afraid to go vote:

Hochul’s comment is not proof that she was inviting noncitizens to cast ballots. It does show why precision matters.

American citizens have every right to vote without intimidation. Noncitizens do not have that right in federal elections, and immigration enforcement does not erase the distinction.

Federal law is straightforward. Title 18, Section 611 generally makes it unlawful for an alien to vote in an election held partly or entirely to choose the president, vice president, presidential electors or members of Congress, subject to narrow exceptions written into the statute.

The Justice Department’s October cases were not the first sweep. A separate September 18 announcement described charges against another 16 individuals in Texas, Wisconsin, New Jersey, Michigan and other jurisdictions.

Those earlier allegations included illegal voting, false voter registration, naturalization fraud and passport fraud. Together, the two announcements show a coordinated federal enforcement push spanning multiple states and more than one election cycle.

At the same time, DHS has said it is not planning to station immigration officers en masse at polling places. The Associated Press reported earlier this month, as early voting was already underway nationwide, that the department dismissed that claim as fearmongering and said its focus is investigating and prosecuting actual violations, not intimidating lawful voters.

That distinction should not be controversial. Eligible citizens should vote, and ineligible noncitizens should not.

Officials should enforce the law without apology and without interfering with anyone’s lawful ballot.

Yet some Democrats are still objecting to the most basic citizenship check. A recent exchange captured Rep. Greg Landsman calling the idea of proving citizenship before registering to vote “absurd”:

Americans are required to prove eligibility for countless government benefits, licenses and legal privileges. Asking election officials to verify citizenship before placing someone on a federal voter roll is not radical.

Allowing unlawful ballots to dilute lawful votes would be.

DHS just made clear that this administration intends to enforce that boundary.
