Many states have already started anticipating what will happen if Roe v. Wade is reversed after a draft opinion was leaked last week that indicates a majority of Supreme Court Justices will vote in favor of overturning it.

Some states already have ‘trigger laws’ in place that would be enacted if Roe is overturned.  The laws strictly regulate abortion but were struck down by Roe v. Wade.  Left-wing Attorney Generals like Dana Nessel have refused to enforce the laws in advance.

Democrats are trying to push through a federal law that could allow abortions all the way until ‘fetal viability’, which is at 23 or 24 weeks.  It would be more radical than most state laws allowing abortion.

Republicans have other ideas about what they will do if they retake Congress in the midterms.

Today, Senate Minority Leader Mitch McConnell suggested that he would be open to a federal abortion ban if Roe is reversed and Republicans regain a House and Senate majority in the midterms.

“Senate Minority Leader Mitch McConnell (R-Ky.) said that a nationwide ban on abortion is a possibility if the Supreme Court overturns Roe v. Wade, as was suggested after a draft opinion that signaled the high court would rule against the landmark 1973 decision.

“If the leaked opinion became the final opinion, legislative bodies—not only at the state level but at the federal level—certainly could legislate in that area,” ​the Kentucky Republican said in a recent interview.

“And if this were the final decision, that was the point that it should be resolved one way or another in the legislative process. So yeah, it’s possible,” ​McConnell told USA Today Saturday when asked if a nationwide abortion ban is worthy of debate.”
